Welcome to Shammika Deshan Online Academy (Pvt) Ltd (“the Academy,” “we,” “us,” or “our”). These Terms of Service (“Terms”) constitute a legally binding agreement between Shammika Deshan Online Academy (Pvt) Ltd and the user—whether a student, parent, or legal guardian (“you” or “Student”). By registering for our classes, using our website, accessing our Learning Management System (LMS), or making payments, you acknowledge that you have read, understood, and agreed to be bound by these Terms.

1. Services Provided

Shammika Deshan Online Academy (Pvt) Ltd provides structured educational mathematics instruction for Grades 6 through 11 (O/L) across Sri Lanka. Services include:

• Weekly live interactive Zoom classes conducted personally by teacher Shammika Deshan.

• Monthly printed physical tutorial packs and term test revision materials delivered to your residential address.

• Access to digital class recordings, supplementary study resources, and marking schemes via our online LMS platform.

• Direct homework review, feedback, and individual doubt clearing via WhatsApp.

2. Enrollment, Accounts, and Supervision of Minors

• Parental Consent: Because our primary students are minors (Grades 6 to 11), enrollment, communication, and payments must be completed under the supervision and authority of a parent or legal guardian.

• Accuracy of Information: You agree to provide accurate and complete information upon registration—including student details, active contact numbers, and a valid postal delivery address in Sri Lanka.

• Account Integrity: LMS accounts and login credentials are non-transferable and issued strictly for personal student use. Sharing, selling, or distributing account access to unregistered third parties will lead to immediate account suspension without refund.

3. Fees, Payments, and Billing Policy

• Monthly Tuition Fee: The standard monthly tuition fee is LKR 1,500 per grade batch, unless otherwise officially stated.

• Inclusions: The LKR 1,500 monthly fee covers access to all live Zoom sessions, LMS class recordings, homework evaluation, and 100% free doorstep delivery of printed monthly tutorials anywhere in Sri Lanka.

• Payment Schedule: Fees are payable in advance at the beginning of each billing cycle via approved online bank transfer or direct payment gateways.

• Refund Policy: Due to the direct allocation of resources, tutorial printing costs, and free courier dispatch, monthly tuition fees are non-refundable once the course cycle has commenced and tutorial packs have been prepared or dispatched.

4. Tutorial Delivery Policy

• Free Nationwide Shipping: We provide free home delivery of monthly printed tutorial booklets across all 25 administrative districts of Sri Lanka.

• Delivery Information: Parents/guardians are solely responsible for providing an accurate physical street address and reachable phone number to prevent delays by the courier or postal authorities.

• Dispatch Timeline: Tutorials are dispatched prior to or at the start of each curriculum month. We are not liable for regional shipping delays caused by adverse weather, postal strikes, or force majeure events outside our direct operational control.

5. Intellectual Property Rights

• Exclusive Ownership: All instructional materials—including printed tutorial booklets, exam revision sheets, past paper marking schemes, lecture notes, video recordings, website copy, and digital branding—are the exclusive intellectual property of Shammika Deshan Online Academy (Pvt) Ltd and teacher Shammika Deshan.

• Prohibited Use: You may not copy, reproduce, scan, record, republish, resell, upload to external websites, or distribute our course content or live lectures in any public or commercial format without explicit prior written authorization.

6. Classroom Conduct and Acceptable Use

• Respectful Environment: Students must maintain decorum, discipline, and respect toward the instructor and fellow peers during live Zoom sessions and within designated WhatsApp support groups.

• Prohibited Behavior: Any form of verbal harassment, inappropriate chat commentary, distribution of unauthorized links, or disruptive behavior during online sessions will result in immediate expulsion from the session and potential termination of academy enrollment.

7. Disclaimer and Academic Expectations

• Commitment to Quality: We guarantee structured teaching, high-quality physical tutorials, and dedicated guidance by teacher Shammika Deshan.

• No Guarantee of Unrealistic Outcomes: While our students consistently achieve top grades, academic results depend directly on individual student dedication, regular class attendance, active homework completion, and consistent practice. In accordance with our values, we do not make false guarantees of effortless success or magic academic shortcuts.

8. Limitation of Liability

To the maximum extent permitted under Sri Lankan law, Shammika Deshan Online Academy (Pvt) Ltd shall not be held liable for:

• Technical interruptions, internet service outages, power cuts, or device malfunctions experienced on the student’s end during live Zoom broadcasts.

• Incidental or consequential damages arising from the temporary unavailability of LMS servers during scheduled maintenance.

9. Governing Law and Jurisdiction

These Terms of Service are governed by and construed in accordance with the laws of the Democratic Socialist Republic of Sri Lanka. Any legal disputes or claims arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts of Sri Lanka.
